Fan Terms of Use

These Fan Terms apply to your use of creator pages on witme.io and related fan features powered by EchoFlux.ai and Fan Hub technology.

1. Scope of These Terms

These Terms apply when you browse creator pages, create a fan account, purchase memberships, unlock paid content, send direct messages, tip creators, or book sessions where available.

By using these features, you also agree to the applicable privacy policy and any checkout-specific notices presented before payment.

2. Eligibility and Account Use

You must be at least 18 years old (or the legal age in your jurisdiction, if higher) to create an account or complete paid transactions.

You are responsible for your account credentials and activity conducted through your account. If you suspect unauthorized access, contact support promptly.

3. Creator-Page Offerings

Each creator controls their own page configuration. Offerings can vary and may include recurring memberships, paid posts, tips, direct messaging, or session-based experiences.

Offer availability, feature access, and pacing are creator-specific and may change over time.

4. Purchases, Billing, and Renewals

When you complete a purchase, you authorize the selected payment method for the full checkout amount, including applicable taxes and fees where disclosed.

Memberships may renew automatically at the interval shown during checkout until canceled before renewal. Failed payments may pause paid access until resolved.

5. Refunds and cancellations

Unless otherwise stated at checkout or required by law, digital purchases are generally final after access is granted.

Canceling a recurring membership (without deleting your account) typically ends future renewals and keeps access until the end of the billing period you already paid for, unless checkout states otherwise.

If you delete your fan account, access ends immediately and recurring memberships are canceled so you are not charged again. That does not refund amounts already billed for the current period unless required by law or stated at checkout.

6. Messaging and Session Expectations

Direct messages and sessions are creator-controlled experiences. Response timing, frequency, and availability are not guaranteed.

Where permitted, creators may use assistants or moderation workflows to operate their accounts.

7. Use Restrictions

Creator content and fan/creator messages are for personal, on-platform use only. Without explicit written permission, you may not copy, republish, scrape, record, or commercially reuse creator material.

You may not redistribute paid content, share private messages publicly, or use creator media to train third-party machine-learning models.

8. Prohibited Behavior

You may not use the service for harassment, threats, hate, fraud, impersonation, payment abuse, or other unlawful conduct.

Attempts to bypass blocks, evade restrictions, or interfere with platform operations may result in immediate access limitations.

9. Blocking, Reporting, and Safety

Creators can block fans from messaging or purchases where available. Fans may submit reports concerning abuse, rights violations, or unsafe behavior.

Platform operators may review relevant records to investigate incidents, enforce policy, and comply with legal obligations.

10. Platform role

EchoFlux.ai and witme.io provide infrastructure, authentication, and payment integration. Creator-specific offers and fan interactions are primarily between creator and fan.

The platform does not guarantee creator response times, outcome quality, or ongoing availability of any specific creator program.

11. Service Availability

We may modify, maintain, suspend, or discontinue features from time to time, including for upgrades, security, or legal compliance.

Temporary interruptions may occur due to network, infrastructure, payment-provider, or third-party service dependencies.

12. Disclaimers and Liability Limits

To the fullest extent permitted by law, services are provided on an "as available" and "as is" basis without warranties of uninterrupted operation.

Indirect, incidental, special, and consequential damages are excluded where legally permitted. Non-waivable consumer rights remain preserved.

13. Suspension and Termination

We may restrict or terminate access for policy violations, fraud risk, legal requirements, or safety concerns.

Upon termination, access to paid features may end immediately, subject to applicable law.

14. Changes to These Terms

We may revise these Terms periodically and will update the effective date when changes are published.

Your continued use after changes become effective constitutes acceptance of the revised Terms unless law requires otherwise.

15. Governing Law

These Terms are governed by applicable law as determined by your region and mandatory legal protections. Jurisdiction-specific rights may apply.
